These General Terms and Conditions (GTC) apply to every booking made by PokerAcademy (hereinafter referred to as "PA" or "Organizer") and govern the business relationship between PA and the Customer. With the placing of the order these are considered as accepted by the business partner. If special conditions apply to certain events, these will be explicitly mentioned in the respective invitation to tender. These GTC are applicable to all events taking place.
The booking can be made in writing or by telephone to the PA. With the receipt of the written or telephone confirmation at the PA, a contract between the two parties is concluded. From this moment the rights and obligations from the contract become effective according to the OR.
The organizer undertakes to provide the services for that activity, which he offers according to the descriptions in his offer. Special requests can be considered after consultation with the PA. Any additional costs will be borne by the customer.
The prices for the activities can be taken from the delivered offer or the order confirmation and are in Swiss francs. Prices are expressly subject to change. For additional services up to CHF 120.00 per hour can be charged. As a rule, additional costs will be discussed with the customer in advance.
For new customers and private customers, an advance payment is usually required. For recurring customers, the final invoice is issued after the end of the event. This is to be paid within ten (10) days after receipt of the invoice. If payments are not made on time, the organizer is entitled to withhold the services or to cancel the contract. Any cancellation costs shall be claimed from the customer in accordance with clause 6. Invoices for ordered vouchers are to be paid like short-term, definite bookings in any case (also in case of cancellation!). A payment period of 5 days applies. The vouchers can also be sent by e-mail on request.
Cancellation by the customer before the event must be communicated by registered letter stating the reason. An e-mail cancellation is only valid if it is reconfirmed by PokerAcademy. The following cancellation fees are due:
Up to 14 days before the event: CHF 200.00
13-7 days before the event: 30% of the fee
6-3 days before the event: 50% of the fee
2-0 days prior to the event: 100% of the fee
PokerAcademy is committed to its customers to prepare and carry out the activities conscientiously and professionally. The participants are responsible for sufficient insurance coverage themselves. The PA excludes any liability for damage, theft or loss of items incurred during an event. Soft wooden floors may be slightly scratched by the legs of the PokerAcademy poker tables. The place for setting up the poker tables is determined by the customer on his own responsibility.
All personal information made available to the organizer during booking and event discussion will be treated confidentially and used for internal purposes only. PokerAcademy undertakes not to make lists of participants at poker events public and that all employees maintain silence about who participated in which events and when. Photos on which participants or company and private premises are clearly recognizable will only be published after consultation with the customer. Photos taken at trade fairs may be made public without the explicit permission of the person photographed. If you find yourself in pictures and do not consent to publication, please contact us immediately. E-mail addresses of customers and course participants are usually automatically entered into our newsletter system. These will be deleted immediately upon request, the unsubscription can be done independently with one click.
If PokerAcademy holds contests and raffles, any person residing in Switzerland is eligible to participate. As a rule, prizes are not sent abroad.
Swiss law is exclusively applicable. The exclusive place of jurisdiction for all disputes arising from this contract is Stallikon ZH.
